Terms of Service

1. Who You're Agreeing With

These Terms govern your use of RestroPod — the Windows POS, an Android app and the SaaS backend that supports them. By creating an account or using RestroPod, you agree to these Terms.

RestroPod is built and operated by Aditya Joshi, an individual based in Indore, Madhya Pradesh, India. RestroPod is not currently a registered company.

2. Who Can Use RestroPod

RestroPod is intended for owners and operators of a single-outlet restaurant or shop in India. By registering, you confirm the details you provide (business name, owner name, contact details) are accurate.

3. Your Account

  • You are responsible for keeping your login details and password secure.
  • You are responsible for everything that happens under your account, including actions taken by staff you allow to use it.
  • If you believe your account has been accessed without permission, contact us immediately.

4. Subscriptions and Payment

  • RestroPod is offered on paid subscription plans, shown on our pricing page. Some plans include optional modules such as Cloud Reporting and E-Bill.
  • Payment is processed through Razorpay. By subscribing, you agree to Razorpay's own terms for payment processing as well.
  • Plans, prices, and features may change. If we change your current plan's price or features, we'll notify you before it takes effect.
  • Some plans have a first-time price and a different renewal price. The price you pay is shown at checkout and on your invoice.
  • RestroPod is not currently registered for GST, so invoices do not include GST. If that changes, we will tell you before it applies.
  • We may give a plan to a customer at no charge or at a special price. Such a plan follows these Terms too.
  • When a plan ends there is a grace period, and then the POS locks until you renew. See the Service Level Terms, Section 6.
  • Refunds are governed entirely by our separate Refund & Cancellation Policy — by subscribing, you agree to those terms too.

5. Your License to Use RestroPod

Using RestroPod (Windows POS, Android app, or SaaS) gives you a license to use the software under these Terms — full details are in our License / Activation Terms document, which is part of this agreement. What to expect from Cloud Reporting and E-Bill delivery specifically is covered in our Service Level Terms.

6. Acceptable Use

You agree not to:

  • Use RestroPod for any illegal purpose
  • Attempt to bypass, tamper with, or interfere with license checks, activation, or security measures
  • Reverse-engineer, decompile, or attempt to extract the source code of RestroPod
  • Resell, sublicense, or redistribute RestroPod without our written permission
  • Use RestroPod in a way that could damage, disable, or overburden our servers
  • Use the E-Bill feature to send unsolicited, unlawful, or spam messages to anyone who has not consented to receive them

If we determine you've violated any of these, we may suspend or terminate your account.

7. DPDP Act Addendum: Your Customers' Data & Electronic Communications

Our Privacy Policy and Data Processing Terms explain exactly what data we collect, and what stays only on your device. By using RestroPod, you agree to those terms.

Data Fiduciary Liability: Under the Indian Digital Personal Data Protection (DPDP) Act, 2023 and the Digital Personal Data Protection Rules, 2025, you (the Merchant) are strictly classified as the Data Fiduciary. RestroPod acts solely as a Data Processor. You are solely responsible for obtaining explicit, verifiable consent from your customers before capturing their personal data (such as phone numbers or email addresses) or generating electronic communications (E-Bills).

Telecom & Spam Compliance: If you enable E-Bill delivery through MSG91, Twilio, Fast2SMS, Gupshup, Interakt, or any other gateway you connect, you are responsible for maintaining compliance with TRAI regulations, WhatsApp Business terms, and SMS DLT registrations for that gateway. You agree to fully indemnify and hold RestroPod harmless against any legal actions, spam complaints, gateway account suspensions, or DPDP violations arising from messages dispatched using your own API credentials through our platform.

Cloud Reporting: If your plan includes Cloud Reporting, you acknowledge that aggregated business data, including staff names and performance figures, is synced to our servers as described in the Privacy Policy, Section 2(H). You are responsible for informing your staff of this if required under applicable law.

RestroPod explicitly forces customer contact fields to be optional during POS checkout to comply with Ministry of Consumer Affairs guidelines. Making data collection mandatory for standard billing is a violation of these Terms.

8. Suspension and Termination

We may suspend or deactivate your account if:

  • Your payment fails or your subscription lapses
  • We reasonably believe you've violated these Terms (Section 6)
  • We detect fraud, tampering, or misuse of your license

We will generally try to notify you by email when this happens. Depending on the situation, your account status may be changed to suspended or inactive, and this may be done directly by us, not only automatically.

You may stop using RestroPod at any time by not renewing your subscription.

9. Software Updates

We may release updates to RestroPod. Some updates may be mandatory (for example, security fixes), and you may be required to install them to keep using the software.

10. Ownership

RestroPod — its code, design, branding, and all related intellectual property — belongs to Aditya Joshi. Nothing in these Terms transfers ownership of the software to you. You receive only a license to use it, as described in the License / Activation Terms.

11. Limitation of Liability

This section limits what RestroPod (Aditya Joshi) can be held financially responsible for. Read it carefully.

To the maximum extent allowed by Indian law:

  • RestroPod is provided "as is." We do not guarantee it will be error-free, uninterrupted, or fit for every specific use.
  • We are not liable for indirect, incidental, or consequential losses — including lost profits, lost sales, or business interruption — arising from your use of RestroPod.
  • We are not responsible for losses caused by your own hardware, internet connection, or failure to meet published system requirements.
  • We are not responsible for the accuracy, legality, or consequences of any GST, tax, or billing calculations you generate using RestroPod. You are responsible for verifying these are correct for your business.
  • We are not responsible for any data you store about your own customers, including its accuracy, security on your device, or your compliance with data protection law regarding that data (see Data Processing Terms, Section 1).
  • We are not responsible for message delivery failures, delays, costs, or account issues arising from a third-party E-Bill gateway (MSG91, Twilio, Fast2SMS, Gupshup, Interakt, or SMTP provider) you have connected using your own credentials.
  • If, despite all of the above, we are found liable for something, our total liability to you is limited to the amount you paid us in the 3 months before the issue occurred.

Nothing in this section limits liability that cannot legally be limited under Indian law.

12. Changes to These Terms

We may update these Terms from time to time. If we make a significant change, we'll notify you by email or through your dashboard. Continuing to use RestroPod after a change takes effect means you accept the updated Terms.

13. Governing Law

These Terms are governed by the laws of India, including the Digital Personal Data Protection Act, 2023 and the Digital Personal Data Protection Rules, 2025. Any disputes will be handled exclusively in the courts of Indore, Madhya Pradesh.
